Company fined after an investigation by the U.S. Department of Labor’s Wage and Hour Division
Uptown restaurant Superior Seafood, known for its oyster happy hour, frozen cocktails, and prime parade route placement, has paid out $238,300 in back wages and damages after an investigation by the U.S. Department of Labor’s Wage and Hour Division (WHD).
The investigation found that the company violated the Fair Labor Standards Act (FLSA) by improperly calculating hours for employees and failing to pay overtime in cases it was required. The overtime rates it did pay were lower than those required by law, and the WHD also cited Superior Seafood for record-keeping violations. The DOL announcement says the back wages and damages paid went to 222 employees.
The folks behind Southeast Louisiana Mexican chain Superior Grill opened Superior Seafood in 2012, and the sprawling corner restaurant on St. Charles Avenue quickly became a Mardi Gras destination. Its daily 50 cent oyster happy hour is also known to draw crowds.
The news follows last week’s DOL announcement that New Orleans restaurant Jacques-Imo’s paid up after violating the Fair Labor Standards Act (FLSA); Jacques-Imo’s apparently violated child labor laws (including one that resulted in the third-degree burn of a minor).
