‘You want me to pop you?’: Man accused of shooting stranger who laughed at him in St. Claude


Tamyron McClain, 21, faces charges of attempted second-degree murder and discharging a firearm during a violent crime.

A 21-year-old St. Roch man who was arrested last week on an attempted murder charge is accused of shooting a 49-year-old man outside a St. Claude neighborhood gas station in January after the 49-year-old stranger laughed at him, NOPD records show.

Tamyron McClain, whose home address was listed in the 2400 block of North Claiborne Avenue, was standing outside Quicky’s gas station, 1535 Franklin Ave., at the same time that the 49-year-old man and his wife were waiting there for a ride to pick them up, according to the affidavit for McClain’s arrest warrant.

The wounded man’s wife told New Orleans police that the couple overheard the younger man – who police later identified as McClain -- talking on his cellphone, saying that police had a warrant for his arrest and that he couldn’t go home because police were there, the affidavit states.

The 49-year-old man “then laughed,” the affidavit states, prompting the man on the cellphone to turn to the 49-year-old man and tell him, “Man, there’s nothing funny. Do you want me to pop you?”

The affidavit states the wounded man’s wife told police that her husband responded, “You going to pop me in front of the store?” Then the younger man, “replied, ‘Yeah!!!’ at which point he produced a small black handgun, which he held in his right hand, and shot the victim,” the affidavit states.

The shooting, which was reported about 7:05 p.m. Jan. 3, was captured on surveillance video, the affidavit states.

At his first appearance hearing on Thursday (April 18), McClain was represented by the Orleans Public Defender’s Office. He was booked on charges of attempted second-degree murder and discharging a firearm during a violent crime.

The affidavit states that to locate the suspected shooter, NOPD Detective Johnny Magee checked calls for service in the area around the time of the shooting and communicated with other officers, then learned of an ongoing investigation into a domestic disturbance a few blocks away, in the 2400 block of Claiborne. A woman at that scene had been taken by EMS to a hospital.

Police interviewed a witness to the Claiborne domestic incident who identified McClain as someone who was at the Claiborne scene and called police, the affidavit states. The witness picked his picture out of a lineup, identifying the photo as McClain.

The witness was then shown the video of the shooting at the Franklin Avenue gas station and asked if they could identify the gunman. The witness confirmed McClain was pictured in the video of the gas station shooting.

The affidavit in connection to the shooting did not identify the perpetrator of the domestic incident.

The warrant for the attempted murder charge was signed Jan. 4. It was not immediately clear why McClain was arrested more than three months later, on April 17.

Orleans Criminal District Court Judge Harry Cantrell on Thursday set McClain’s bond at $160,000.
